State Senator Rob McColley (R-OH SD 01): Civil Asset Forfeiture Reform: "COLUMBUS, Ohio (Jan. 5, 2016) – On Wednesday, Ohio Gov. John Kasich signed a bill that reforms asset forfeiture laws to prohibit the state from taking property without criminal charges in many cases. The new law also takes on federal forfeiture programs by banning prosecutors from circumventing state laws by passing cases off to the feds in most situations. Rep. Rob McColley (R-Napoleon) and Rep. Tom Brinkman Jr. (R-Cincinnati), along with 17 cosponsors, introduced HB347 in 2015. Under current Ohio law, police can seize and keep cash and personal property on the mere suspicion that a crime was committed. But according to a report from Reason, passage into law “switches the burden of proof from the defendant to the government to show why property is connected to a crime and bars civil forfeiture for amounts under $15,000.” The new law also almost completely closes a federal loophole that allows prosecutors to bypass more stringent state asset forfeiture laws by passing cases off to the federal government under its Equitable Sharing forfeiture program." Campaign Website: http://www.jonathandever.com/ State Representative Jim Butler (R-OH HD 41): Served in the U.S. Navy Protecting Civil Liberties: "November 25, 2013-COLUMBUS - State Representatives Jim Butler (R – Oakwood) and Ron Young (R – Leroy Township) have introduced House Bill 354 to address a law passed by Congress and signed by the President that allows the federal government to arrest and endlessly imprison, without trial, any American citizen merely by alleging the citizen aided terrorism. Specifically, the bill addresses a provision of the National Defense Authorization Act (NDAA) of 2012, which states, “Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force includes the authority for the Armed Forces of the United States to detain covered persons pending disposition under the law of war.” House Bill 354 states that no state resources shall be used to aid the federal government in indefinitely detaining any person in this state. Further, it prevents state and local law enforcement officials from assisting the United States military in any investigation, prosecution, or detention that may deprive residents of Ohio to the right to trial if imprisoned. “At this time of year when we come together to give thanks, hopefully we all remember to reflect on the rights and freedoms for which so many Americans have fought and sacrificed. One of the most fundamental of those freedoms is that our government cannot lock you in prison without first proving your guilt at trial before a jury of your peers,” said Representative Butler. “While the Bush and Obama administrations promised not to use the power to indefinitely jail someone without trial, it begs the question ‘Why did both administrations fight so doggedly for it?’. The bill stipulates that, in general, the body camera videos are public record, with several exceptions determined necessary for privacy. “It is the Wild West right now with regards to whether a police worn body camera is a public record: some believe it is, some believe it is not,” said Rep. Antani. “This bill will protect privacy rights, while providing transparency and accountability of all involved in a police encounter. A police body camera will be able to see where you keep your gun, your jewelry, and where you kids sleep. It is essential for us to take steps to protect the privacy rights of our citizens as this new technology is deployed.” Campaign Website: http://www.nirajantani.com/ State Representative Wes Retherford (R-OH HD 51): Served in US Marine Corps from 2002-2004 Protecting Victims of Sexual Crimes: "December 13, 2017-COLUMBUS - State Representative Wes Retherford (R-Hamilton) today announced that he has introduced legislation to increase privacy for sexually oriented offense victims within Ohio’s public record law. The legislation, known as the Victims Privacy and Protection Act, exempts from the definition of a public record photographs, videos or other digital media that depicts the victim of a sexually oriented offense at the time of the offense, or when the release would violate their expectation of bodily privacy. The bill comes in response to a 2016 Ohio Supreme Court Case, Caster vs. Columbus, which leaves digital media that violates bodily privacy available to request through public records law after the conclusion of the initial trial involving the photo or video. This means that images of a nude victim could be released to the public, causing more emotional damage to the victim. “I am proud to introduce the Victims Privacy and Protection Act, along with the support of nearly 70 of my colleagues,” said Retherford. “When I was informed of the possibility of these victims of sexually oriented crimes having their images of an embarrassing nature be subject to public records request, I immediately started to work to find a fix. I believe this bill is an appropriate balance of protecting victims while not hampering our very strong transparency laws. We should recognize the need to prevent re-victimizing these individuals and work to fix this loophole.” Representative Retherford was made aware of this issue by a local police detective in his district who learned of the situation during a routine public records training. The detective alerted Retherford in hopes of providing more privacy protection for victims of sexual crimes. The Victims Privacy and Protection Act now awaits referral to a House committee where it will receive further consideration." It is vitally important to speak for the disabled and make sure their needs are addressed at the Ohio Statehouse. My priority remains giving every person an equal opportunity to succeed—especially those with special needs. In December of 2014, the federal government passed legislation creating the Achieving a Better Life Experience (ABLE) Act, which allows people with a disability to create a tax-advantaged account. To provide for this resource in Ohio, the state legislature passed House Bill 155, thus creating the Ohio ABLE Act. But what exactly is a tax-advantaged account and how does it benefit Ohioans? STABLE accounts are investment accounts, operating in a similar manner to some college savings or retirement accounts. While money can still be withdrawn and deposited, the account gives users the ability to grow and save their money for long-term expenses. The account’s earnings are not subject to federal or state income taxes and can be used for extra expenses that often come with living with a disability. Another advantage of opening a STABLE account is that its funds do not count against your eligibility for federal benefits programs. An individual or a family member can deposit up to $14,000 a year, but that money is not considered an asset when determining eligibility for Medicaid or other benefits programs. This allows those who are disabled to keep necessary benefits and still access a resource that allows them to be more financially independent. Living with a disability often brings with it additional costs for healthcare, transportation, technology, and even basic living expenses. Those who have such special needs still deserve the right to more independence and financial security, and STABLE accounts provide that opportunity. The program is administered through the Ohio Treasurer’s office and was officially launched this past June, making Ohio the first state to offer these accounts to those with disabilities and their families. Kyle Koehler (R-Springfield) last week announced the passage of House Bill 359, which establishes an Address Confidentiality Program for domestic violence and sexual assault victims in Ohio. This legislation allows for domestic violence victims, as well as victims of rape, sexual battery, menacing by stalking and human trafficking, to register to vote while keeping their home address confidential. The victims would be assigned an Address Confidentiality Program number that they can use instead of their home address when filling out an election ballot. The Secretary of State’s office will administer the program. “House Bill 359 addresses an issue that while difficult to talk about, restores some of the most fundamental rights lost by victims of domestic violence,” Rep. Koehler said. “We often take for granted these rights, but as legislators, we must make sure to protect these individuals.” House Bill 359 passed unanimously and now goes to the Ohio Senate for further consideration. Cynthia Flores is a social service programs manager, a leader in the local Chamber, and a conservative leader with a proven conservative reform record of getting results: "For Cynthia Flores, faith, family, and service are a way of life modeled by her parents, John J. and Jeanette Hernandez, who raised eight children in Fort Worth, Texas. John J. Hernandez, 86, was a pressman, who started his own business at the age of 50. He often worked two or three jobs to make ends meet. Her mother, Jeanette, a nurse by trade, left her career to remain at home and raised Cynthia and her siblings. Today, the family business her father started more than 35 years ago is a highly successful printing company, Johnsons Press, managed and operated by her four brothers. Simplicity defined Cynthia’s childhood. There was one family car, restaurants were special events, and family vacations involved camping in the Texas State Parks. A life of faith and service to the Catholic Church and School, which were directly across the street from their home, became the family priority. Cynthia attended All Saints Catholic Elementary and Nolan Catholic High School. As did her siblings, she worked and paid her way through college. After two years at the local junior college, she commuted to The University of North Texas, in Denton, where she earned her BS degree in Rehabilitation Studies. Inspired by her parents’ example, Cynthia began to give back in both a professional and volunteer capacity. Upon graduation, she worked for Tarrant County MHMR, as a Vocational Evaluator, testing individuals with Mental Retardation to determine skills and interests for employment. She moved to Heart of Texas MHMR, in Waco, to continue on the same career path. She later worked as a Qualified Mental Retardation Professional in a group home with 10 adult individuals. In 2007, Cynthia transitioned from volunteer to professional Case Manager and coordinates the social service programs. Established in 1986, RRASC is a faith-based organization that operates a food pantry and provides social services for families in need. Cynthia works with the RRASC team in assisting an average of 1,100 families per month with food and financial assistance for rent, utilities, prescriptions, temporary lodging, and transportation. Programs also include: Keep Round Rock Warm, a coat distribution project, Computers for Kids, Community Gardens, adult computer classes and an alternative loan program to assist families in breaking the payday lending cycle. Also in 2007, Cynthia enrolled in the Round Rock Chamber’s Leadership Round Rock Program, graduating in May 2008. Today, she is involved with the Leadership Round Rock Planning Committee, serving as Community Service Day Chair. In 2017, she became the Events Chair and has assisted in organizing the events for the Chamber. She has participated in the Chamber’s Workforce Launch programs, placing student interns with employers and bridging the gaps between employers and veterans. She served two years on the Round Rock Chamber’s Board of Directors. As an Ambassador for the Chamber, since 2008, she has had the opportunity to welcome numerous new business investors to the Round Rock area." The law ensures that teachers who engage in an inappropriate relationship with a student will lose their teaching certification/license and their taxpayer pension, and punishes administrators, superintendents and principals who turn a blind-eye to such misconduct. The bill also requires school districts to adopt a written policy to prevent improper electronic communications between school employees and a student." Governor Abbott: "Texas schools are filled with some of the best teachers in the country, but unfortunately a small number of them have abused their position, and as a parent I find this abuse of trust abhorrent. This type of behavior is unacceptable, and Texas will protect its children from sexual predators in our classrooms. I would like to thank the legislature for their work and dedication on this important law." Allowing for the Use of Cannabidiol Oil for Epilepsy Patients: Senate Bill 339 (SB 339): "authorizes the use of CBD oil only for patients with intractable epilepsy (IE), requires two certified specialists to approve the drug for a patient and requires DPS to regulate entities who meet the strict qualifications for manufacturing and dispensing CBD oil. IE afflicts an estimated 149,000 individuals in Texas, typically children, and patients with IE can suffer hundreds of seizures per week." “There is currently no cure for intractable epilepsy and many patients have had little to no success with currently approved drugs,” said Governor Abbott. “However, we have seen promising results from CBD oil testing and with the passage of this legislation, there is now hope for thousands of families who deal with the effects of intractable epilepsy every day.” Prohibiting Online Solicitation of a Minor: Senate Bill 344 (SB 344): "It is regrettable that this bill is necessary. In 2013, the Court of Criminal Appeals barred the State from prosecuting a public school choir teacher named John Christopher Lo for sending sexually explicit text messages to a 15-year-old former student. In doing so, the Court inexplicably held that the First Amendment protects Lo’s sexually explicit communications to a minor. The Court of Criminal Appeals was wrong on the law, and its decision has dangerous consequences for Texas children. Under our current court system, however, this bill is all that the Court of Criminal Appeals ruling enables the Legislature to do to protect our children from dangerous predators. This law will, however, provide law enforcement and prosecutors more tools to combat online predators." Protecting Children & Reforming Foster Care Services: "Governor Greg Abbott today signed several bills that will reform Texas’ foster care system and Child Protective Services (CPS). In his State of the State address, Governor Abbott made reforming CPS an emergency legislative priority and stated that his goal was to have no more child deaths in the Texas foster care system. The signing of these laws allows CPS to place more children with relatives, increase capacity of foster homes by streamlining regulations, and move toward a community-based care system. “Children dying while in the care of the state is intolerable, and these new laws are a needed step to ending such tragedies. I thank the Legislature for their bipartisan support of these measures I declared emergency items. I’d also like to extend my thanks to all CPS staff for their tireless dedication to caring for vulnerable children in trying circumstances.” HB 4 (Burkett, R-Dallas, Schwertner, R-Georgetown): provides financial assistance of 50% of the daily foster care payment to a caregiver with a family income at or below 300% of the federal poverty level. The monthly payments are allowable for one year with the option for a 6 month extension. Upon entering into a formal caregiver agreement, an annual reimbursement payment to aid in childcare expenses is provided. Kinship placements experience fewer disruptions, better outcomes for children, and shorter lengths of stay compared to the traditional foster care system. In addition to being more cost effective than foster care, the kinship allows for children to maintain a familial connection. HB 5 (Frank, R-Wichita Falls, Schwertner, R-Georgetown): established DFPS as a standalone agency. Requires DFPS and HHSC to enter into contracts for the provision of “shared administrative services” including payroll, procurement, information resources, rate setting, purchasing and contracting. Prioritizes child care licensing investigations of abuse and neglect by transferring them to CPS investigations. This restructuring will improve the pace of decision-making in abuse and neglect investigations and afford an organizational flexibility for DFPS to manage its service delivery and workforce more effectively. With greater oversight and direct reporting to the Governor, the agency will continue focus on quality timely investigations, well-trained workforce and accountability for decisions. HB 7 (Wu, D-Houston, Uresti, D-San Antonio): reforms the court processes and procedures for child welfare suits. It maintains many protections for parents trying to navigate the court process and efforts intended to reduce trauma for vulnerable children. By clarifying the child protection services suits, motions and services by DFPS, children and families can be reunited faster. This bill would also create greater flexibility in the licensing of foster care providers, so as to aid in growing much needed capacity. The changes in statute will allow existing high quality providers to build off of their current license without the restrictions which previously existed. SB 11: (Schwertner, R-Georgetown, Frank, R-Wichita Falls): provides for the expansion of community based care (CBC) and transfer case management function from the state to the CBC provider. Requires the creation of Case Management Vendor Quality Oversight and Assurance Division for monitoring of contract adherence and to better assure the positive outcomes our children deserve, the provider will have opportunities for financial incentives, but also for penalties if necessary. Requires the tracking of recurrence of victims and perpetrators, and aligns the definitions for investigations in facilities to match existing CPS investigations definitions. Bill takes steps to reduce amount of time a child’s situation is unresolved by requiring automatic dismissal of trials not commenced after a year and ends court jurisdiction. Improves the process for a child entering the state’s care to receive an initial medical exam not later than the third business day after the date of removal if the child is removed as the result of sexual abuse, physical abuse or obvious physical injury or has a chronic medical condition, medically complex condition or diagnosed mental illness, but clarifies that a physician conducting examination may not administer vaccinations unless it is an emergency tetanus vaccination."
